On April 29, 2025, the National Consumer Service (“SERNAC”) published an interpretative opinion on in-store recalls (the “Opinion”). The opinion analyzes the legality of charges for in-store pick-up or home delivery in sales made through the Internet, determining that, once the contract of sale of a good is concluded through electronic means, the consumer has the obligation to pay the price and the supplier has the obligation to deliver the purchased good. Consequently, SERNAC interprets that no additional amount can be charged for this fact if there is no other free delivery method.
